Kevin Spacey is inching closer to being off the hook for allegedly groping a busboy in a Nantucket bar after the man dropped his lawsuit.

According to the L.A. Times, attorney Mitchell Garabedian announced that the civil suit filed June 26 in Nantucket Superior Court has been voluntarily dismissed.

Garabedian, who represented the 18-year-old man who claimed he was fondled by Spacey, did not give a reason for the dismissal, or if a settlement was reached with the disgraced actor.

According to court records, the dismissal was done “with prejudice,” which means it cannot be refiled.

Spacey may have dodged one hurdle, but he still faces a criminal charge over the same incident
